Terms of Service

This is a template drafted to match how Real actually works today. It is not a substitute for review by a lawyer licensed in your jurisdiction, and should get that review before this product handles real money (contest prizes, advertiser deals) or scales past a small user base.
1. Acceptance of these Terms
These Terms of Service ("Terms") are an agreement between you and [Your Legal Entity or Name] ("Real," "we," "us," or "our") governing your access to and use of the Real website, apps, and related services (together, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use Real. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian, to the extent required by applicable law. By using Real, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.
Real is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we have collected information from a child under 13, we will delete it. See our Privacy Policy for more on this.
3. What Real is
Real is a photo-sharing service built around a simple premise: the photos in the feed were actually taken by a camera, not generated or substantially altered by AI. We support that premise with community reporting and human moderation, not a fully automated detector — every report of suspected AI-generated content is reviewed by a human before any post is removed, and every removal can be contested by its author.
We do not guarantee that every photo on Real is authentic. Our moderation process reduces the presence of AI-generated content but cannot detect it with certainty in every case. You should not rely on a photo's presence on Real, on its "visible" status, or on the outcome of any moderation review as a guarantee of authenticity.
4. Accounts
You need an account to post, report, or interact with content on Real. When you register, you agree to:
- provide a working email address and keep it current;
- choose a username that follows our format rules (3–30 characters, lowercase letters, numbers, and underscores only) and that does not impersonate another person or brand;
- keep your password confidential and secure;
- notify us promptly if you believe your account has been compromised; and
- maintain only one account per person, unless we agree otherwise in writing.
You are responsible for all activity that happens under your account, whether or not you authorized it, except to the extent that activity results from our failure to safeguard your account information.
5. Your content and the license you grant us
"User Content" means anything you upload, post, or submit through the Service — photos (both the version we display and the original file), captions, profile information, avatar images, reports, and contest statements. You own your User Content. We don't take ownership of it by you posting it.
By submitting User Content, you grant Real a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and create technical copies of (e.g. resized display versions) that User Content, solely for the purposes of operating, providing, promoting, and improving the Service. This license ends when you delete the content or your account, except: (a) to the extent it was shared with or reposted by others through normal use of the Service before deletion, and (b) for copies retained for a reasonable period in backups, audit logs, or as required by law.
By submitting User Content, you represent and warrant that:
- you took the photo yourself, or otherwise own or have all necessary rights and permissions to grant the license above;
- your content does not infringe or violate any third party's copyright, trademark, privacy, publicity, or other legal rights;
- if a photo depicts other identifiable people, you have their permission to post it; and
- the camera and capture-time metadata attached to your upload (if any) is accurate and not falsified.
6. Prohibited content and conduct
The core rule of Real: don't post AI-generated or substantially AI-altered images and represent them as real photography. Beyond that, you agree not to use the Service to:
- post content that is illegal, or that infringes someone else's intellectual property, privacy, or publicity rights;
- post sexually explicit content involving minors — this is zero-tolerance and will be reported to the relevant authorities (e.g. the National Center for Missing & Exploited Children in the United States);
- harass, threaten, or impersonate any person or entity;
- post spam, or use the Service for unauthorized advertising or solicitation;
- submit false reports in bad faith, or coordinate with others to submit reports for the purpose of harassing an author rather than flagging genuinely suspected AI content;
- attempt to circumvent our moderation process, including by re-uploading content that was previously removed as confirmed AI-generated;
- scrape, crawl, or use automated means to access the Service beyond what our published APIs (if any) allow;
- probe, penetrate, or attempt to bypass the security or access controls of the Service; or
- upload malicious code or files.
7. Reporting, moderation, and contests
This is how enforcement actually works on Real, concretely:
- Any signed-in user other than a post's author can report it as suspected AI-generated content. Reports are confidential — we do not tell a post's author who reported them.
- A post that receives a report is flagged and temporarily hidden from the public feed while it's reviewed. The author is notified that this happened.
- The author may contest a flagged post by submitting a statement. A contested post moves to "under review" for a human moderator to evaluate.
- A moderator resolves the review as either "not AI" (the post is restored to the visible feed) or "confirmed AI" (the post is removed). Either outcome, and the reason for it, is recorded and the author is notified.
- Accounts with a pattern of confirmed AI-generated content, or that otherwise violate these Terms, may be suspended or terminated at our discretion, as described in Section 8.
We aim to apply this process consistently, but moderation decisions ultimately involve human judgment, and we do not guarantee any particular outcome, review timeline, or that every violation will be caught.
8. Content removal, suspension, and termination
We may remove any content, and suspend or terminate any account, that we believe in good faith violates these Terms, violates the law, or creates risk or legal exposure for us or for other users — with or without notice, and with or without going through the reporting/contest process described above (for example, in response to a valid legal request, or content we identify ourselves rather than via a user report).
You may stop using the Service at any time. Because Real does not currently offer self-service account deletion, contact us at [your-contact-email] to request that your account and associated content be deleted, and we will process that request within a reasonable time, subject to Section 5's note on residual copies and to any content we're required to retain by law.
9. Our intellectual property
The Real name, logo, and the Service's software, design, and branding are owned by [Your Legal Entity or Name] or our licensors and are protected by intellectual property law. Nothing in these Terms gives you any right to use our trademarks or branding without our prior written permission.
10. Copyright complaints (DMCA)
We respect intellectual property rights and respond to clear notices of alleged copyright infringement. If you believe content on Real infringes your copyright, send a written notice to our designated agent that includes, at minimum:
- a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material you claim is infringing, and information reasonably sufficient for us to locate it on the Service (e.g. a link);
- your contact information — address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on their behalf.

If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notice with: your signature, identification of the removed material and where it appeared before removal, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, your contact information, and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the U.S., an appropriate judicial district) and that you'll accept service of process from the person who filed the original notice.
We may terminate the accounts of users determined to be repeat infringers.
11. Third-party services
Real is built on third-party infrastructure providers, currently including Supabase (database, authentication, and file storage) and Vercel (hosting). These providers process data on our behalf as described in our Privacy Policy; we are not responsible for their independent acts, but we choose providers that offer contractual data-protection commitments appropriate to the data we handle.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT CONTENT DISPLAYED ON THE SERVICE IS AUTHENTIC, NON-AI-GENERATED, OR ACCURATELY LABELED, NOTWITHSTANDING OUR MODERATION EFFORTS.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR LEGAL ENTITY OR NAME] AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, OR FROM ANY CONTENT POSTED BY OTHER USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless [Your Legal Entity or Name] from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: your User Content, your violation of these Terms, or your violation of any third party's rights.
15. Governing law and disputes
These Terms are governed by the laws of [Your State/Country], without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in [Your State/Country], and you consent to their jurisdiction.
Many startups add a binding-arbitration and class-action-waiver clause here instead of court litigation. That can meaningfully reduce litigation costs and exposure, but enforceability rules differ by state and country and drafting it wrong can make it unenforceable (or worse) — this is a good, specific question to bring to a lawyer rather than a template.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you (e.g. via an in-app notification or email). Continued use of the Service after changes take effect means you accept the updated Terms.
17. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
